Kejahatan agresi

Kejahatan agresi atau kejahatan terhadap perdamaian adalah perencanaan, permulaan, atau pelaksanaan tindakan agresi berskala besar dan serius dengan menggunakan kekuatan militer negara. Definisi dan ruang lingkup kejahatan ini masih kontroversial. Statuta Roma memuat daftar lengkap tindakan agresi yang dapat menimbulkan tanggung jawab pidana individu, yang meliputi invasi, pendudukan militer, aneksasi dengan menggunakan kekerasan, pemboman, dan blokade militer terhadap pelabuhan. Agresi pada umumnya merupakan kejahatan kepemimpinan yang hanya dapat dilakukan oleh mereka yang memiliki kekuasaan untuk membentuk kebijakan agresi suatu negara, dan bukan oleh mereka yang melaksanakannya.

Agresi adalah salah satu kejahatan inti dalam hukum pidana internasional, selain genosida, kejahatan terhadap kemanusiaan, dan kejahatan perang. Pada tahun 1946, Pengadilan Militer Internasional memutuskan bahwa agresi adalah "kejahatan internasional tertinggi" karena "di dalamnya terdapat akumulasi kejahatan secara keseluruhan".
